The Rose Bowl Aquatic Center, which a jury named primarily liable for the repeated sexual abuse of a young boy, has settled with the family before the case proceeded to an appellate court.
Earlier this year, a jury deemed the Pasadena, Calif. facility 70% responsible for the molestation of a then-11-year-old boy by a 57-year-old patron. The man, accused of abusing the child several times over the course of approximately six months, left the country after the allegations came to light. In court proceedings, the boy’s family placed most of the blame on the aquatics center, saying it violated state reporting laws and failed to provide adequate safeguards against such incidents. With the perpetrator gone, the jury agreed and required the Rose Bowl Aquatic Center to pay $7 million.
As officials prepared to file an appeal, the parties came to a settlement. The Rose Bowl Aquatic Center will pay approximately $4.5 million — $4.4 million to the child and $100,000 to his mother. Approximately $1.75 million of the award will cover attorney’s fees, medical costs and other expenses.
The aquatics center does not agree that it holds primary liability, but believes the perpetrator should hold sole accountability. “We still disagree with the verdict, but we respect the jury’s decision,” said Kurt Knop, executive director of the Rose Bowl Aquatic Center. “And we respect, most importantly, the fact that this matter was able to be settled and is resolved.”
Despite its opposition to the jury outcome, the organization has made changes. “There are numerous things that we’ve already engaged in, and we’ll continue to roll out in 2019, in the sole spirit and hope of not just reacting to this case, but making it a better, safer, more comfortable and family-friendly facility,” Knop said.
